This Terms and Conditions of Service & Trip Participation Agreement (“Agreement”) is entered into between DD Journey Private Limited, operating under the brand name DD Spiritual (“Company”, “DD Spiritual”, “we”, “us”, “our”), and the individual or entity who accesses the website, makes a booking, or participates in any service (“Participant”, “Client”, “you”).
1. Nature of Services & Role of the Company
1.1 DD Spiritual operates as a travel facilitator and coordinator. The Company does not own, manage, or control temples, religious institutions, heritage sites, transport operators, accommodation providers, trekking operators, guides, or government authorities.
1.2 All services are delivered through independent third-party providers and are subject to their respective terms, policies, availability, and regulatory requirements.
1.3 The Company does not guarantee specific darshan timings, queue durations, rituals, access permissions, weather conditions, or uninterrupted service at any destination.
2. Acceptance of Risk & Participant Responsibility
2.1 The Participant acknowledges that travel, trekking, wellness activities, visits to religious and heritage sites, and participation in group tours involve inherent risks, including but not limited to illness, injury, fatigue, loss, delays, inconvenience, or unforeseen circumstances.
2.2 The Participant voluntarily assumes all risks associated with participation and accepts full responsibility for personal safety, conduct, fitness, and preparedness.
2.3 The Participant represents and warrants that they are medically, physically, and mentally fit for the selected Trip and have disclosed all relevant health conditions prior to booking.
2.4 The Company undertakes reasonable coordination for safety and comfort, but does not warrant a risk-free experience.
3. Bookings, Payments & Contract Formation
3.1 A booking constitutes an offer by the Participant and is deemed accepted only upon written confirmation issued by the Company.
3.2 The Participant is responsible for verifying all booking details, itineraries, inclusions, exclusions, travel dates, and documentation requirements at the time of confirmation.
3.3 Payments must be made in accordance with the timelines communicated by the Company. Failure to adhere to payment schedules may result in cancellation without refund.
3.4 Prices are subject to revision until confirmation and may change due to taxes, government fees, temple charges, regulatory changes, fuel surcharges, or third-party cost variations.
4. Cancellations, Refunds & No-Show
4.1 Refunds, if applicable, shall be governed by the Company’s Refund & Cancellation Policy and the terms of third-party service providers.
4.2 No refund shall be granted for voluntary withdrawal, no-show, partial utilisation of services, or early departure from the Trip.
4.3 In the event of cancellation by the Company due to operational constraints or Force Majeure events, the Company may, at its discretion, offer rescheduling or travel credit after deduction of non-recoverable costs.
4.4 The Company shall not be liable for any consequential losses, including airfare, accommodation, visa fees, insurance premiums, or personal expenses incurred by the Participant.
5. Documentation, Permits & Legal Compliance
5.1 The Participant is solely responsible for carrying valid identification, permits, visas, and other documents required by authorities, temples, or service providers.
5.2 The Company shall not be liable for denial of service, entry, or participation due to incomplete, inaccurate, or invalid documentation.
5.3 Participants must comply with all applicable laws, local regulations, temple protocols, cultural norms, safety instructions, and codes of conduct at all destinations.
6. Health, Safety & Insurance
6.1 The Participant bears sole responsibility for personal health and safety during the Trip.
6.2 The Company strongly recommends obtaining comprehensive travel and medical insurance covering illness, injury, evacuation, and trip disruptions.
6.3 In the event of illness, injury, or medical emergency, all related costs, including hospitalisation, evacuation, and repatriation, shall be borne by the Participant. The Company may assist with coordination but assumes no financial liability.
7. Dress Code, Conduct & Cultural Protocols
7.1 Participants must adhere to dress codes prescribed by temples, gurudwaras, pagodas, monasteries, heritage sites, and local authorities. Modest attire covering shoulders and knees, removal of footwear where required, and head coverings at designated sites are mandatory.
7.2 Disruptive behaviour, disrespect of religious practices, consumption of alcohol or intoxicants during spiritual activities, or violation of site-specific rules is strictly prohibited.
7.3 Non-compliance may result in denial of entry by authorities or removal from the Trip without refund. The Company shall not be liable for any inconvenience arising from such non-compliance.
8. Force Majeure
8.1 The Company shall not be liable for delays, cancellations, route changes, or service modifications caused by events beyond reasonable control, including natural disasters, extreme weather, government restrictions, pandemics, strikes, security concerns, or transportation disruptions.
8.2 No compensation or damages shall be payable for Force Majeure events.
9. Itinerary Modifications & Operational Changes
9.1 The Company reserves the right to modify itineraries for safety, regulatory, environmental, or operational reasons.
9.2 Any additional costs arising from such changes shall be borne by the Participant.
10. Luggage & Personal Belongings
10.1 The Participant is solely responsible for personal belongings. The Company shall not be liable for loss, theft, or damage to baggage or personal property.
11. Third-Party Service Providers
11.1 All third-party service providers engaged by the Company are independent contractors and not employees or agents of the Company
11.2 The Company shall not be liable for acts, omissions, misconduct, delays, or non-performance of any third-party service provider.
12. Photography, Media & Intellectual Property
12.1 By participating in a Trip, the Participant grants the Company a non-exclusive, royalty-free, worldwide license to use photographs or videos captured during the Trip for promotional and marketing purposes, unless a written objection is submitted prior to commencement.
12.2 All website content, trademarks, and materials are the intellectual property of the Company and may not be reproduced without prior written consent.
13. Blacklisting & Refusal of Service
13.1 The Company reserves the right to refuse service or blacklist any individual for misconduct, safety violations, harassment, defamation, abuse of services, or violation of this Agreement.
13.2 Blacklisted individuals forfeit future access to services without entitlement to any refund.
14. Limitation of Liability
14.1 To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of services, including personal injury, loss of property, delays, cancellations, or service disruptions.
15. Complaints & Dispute Resolution
15.1 Any complaint must be submitted in writing to the Company within seven (7) days of Trip completion.
15.2 The Parties shall make good-faith efforts to resolve disputes amicably prior to initiating legal proceedings.
16. Governing Law & Jurisdiction
16.1 This Agreement shall be governed by and construed in accordance with the laws of India.
16.2 All disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the competent courts at Patna, Bihar, India.
17. Amendments
17.1 The Company reserves the right to amend, modify, or update these Terms and Conditions at any time without prior notice. Continued use of the website or services constitutes acceptance of the revised terms.
IN WITNESS WHEREOF, by accessing the website, confirming a booking, or participating in any service offered by DD Spiritual, the Participant acknowledges acceptance of the above Terms and Conditions
